Terms and Conditions

QUALIFYING FOR BREAKING EVENTS AT 2018 YOG

By Submitting an Entry, Entrant is entering Stage One Qualifying for Breaking Events at the 2018 Youth Olympic Games, forthwith referred to as Breaking for Gold (or “BfG”). In consideration for being granted the opportunity to enter the Stage One Qualifying competition, Entrant hereby covenants and agrees to all terms and conditions set forth herein into perpetuity.

These terms and conditions were last updated on 2 May 2017. The World DanceSport Federation (also “WDSF”) may amend the BfG qualifying format, information, or these terms and conditions without further notice given to the Entrants, other than terms relating to the use of Entrant’s image and likeness. Any changes will be posted on the BfG website within these terms and conditions.

The World DanceSport Federation’s decision in all matters to do with the BfG will be final and no further correspondence will be acknowledged or issued. The parties to this agreement are World DanceSport Federation and Entrant, whose parent or legal guardian shall enter into this agreement on behalf of Entrant (the “BfG Parties”).

In consideration for admittance to the Stage One Qualifying competition, Entrant unconditionally assigns and transfers to World DanceSport Federation and its licensees or assignees all rights, ownership, title, interest and claim (including without limitation all copyrights), which it now has or may have in the future, to any entry or performance relating to the BfG, including, without limitation, the submitted video, or any element thereof, whether or not acceptable to the World DanceSport Federation and regardless of the form they take. Entrant further grants to World DanceSport Federation the right to use, publish and/or modify any entry, performance and/or video submitted or recorded in connection with the BfG in any manner it wishes, regardless of whether the media is now-existing or hereafter created. Any use of Entrant’s name, performance, likeness, voice or biography shall be without separate compensation to Entrant or to his or her heirs, devisees, executors, administrators, legal representatives or assignees. For the avoidance of doubt, nothing in this agreement shall, however, permit WDSF or its assigns to use Entrant’s name, performance, likeness, voice or biography on any product, service or clothing, or in any manner that constitutes an endorsement by Entrant of any product, service or company, or for any merchandizing programs.

All video entries will be subject to moderation. The World DanceSport Federation and/or its agents have absolute discretion to accept or reject any video entry and to remove any video entry already accepted without giving reasons for the decision. The World DanceSport Federation may in particular refuse to make any video entry public for the following reasons:

  1. inclusion of defamatory, malicious or other content which it in its absolute discretion deems to be objectionable;
  2. inclusion of content in video entries to which someone else owns the copyright or other intellectual property rights;
  3. breach of these terms and conditions,

The World DanceSport Federation reserves the rights to edit and/or modify any video content and publish or advertise the video without Entrant’s approval, acknowledgement or compensation unless prohibited by law. In consideration for being granted the right to enter the Stage One Qualifying competition, Entrant agrees to defend, release and hold harmless the World DanceSport Federation and its agents from and against any claims, action and/or liability for injury, loss or damage of any kind resulting from Entrant’s participation herein (including in connection with the use and/or publication of the submitted video).

The World DanceSport Federation reserves the right to verify eligibility criteria of those who are entitled to move on to Stage Two Qualifying by placing among the top five (5) per country and per gender in the standing that will be established by the Judges.

The World DanceSport Federation has the right to modify, use, assign or dispose of your entry however it sees fit without approval of entrant or any third party. Entrants grant the World DanceSport Federation the right to use their names, images, likenesses, photographs, voices and biographical materials, and video submissions, for advertising, publicity and promotion purposes including posting the videos or screen names online for any purpose or on a winner’s list and other online announcements, and for sharing the videos with the media for viewing, whether TV or print, without additional compensation, unless prohibited by law.

The World DanceSport Federation is not responsible for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or web site, or any other error or malfunction, or any injury or damage to participant’s or any other person’s computer related to or resulting from participation herein, or for any injury to person or property, including but not limited to video equipment, arising from the entrant’s participation. The World DanceSport Federation is not responsible for lost, late, illegible or misdirected entries.

Entrant warrants that their submission is original, that publication of the submission will not infringe on the rights of others, and Entrant has full power to grant ownership to the World DanceSport Federation as stated herein. By entering BfG Stage One Qualifying, Entrants warrant that all information submitted by them is true, current, and complete.

The World DanceSport Federation reserves the right to reject entries which it believes have not been made in compliance with these terms and conditions or to disqualify any Entrant found to have tampered with the entry process or the operation of the BfG Stage One Qualifying or to be acting in an unsportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person.

None of the BfG Parties shall be held responsible for any damage, loss, injury or disappointment suffered by any Entrant entering the BfG. None of the BfG Parties are responsible for any problems or technical malfunction of any computer online systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to Entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in the BfG.

None of the BfG Parties promise that the services relating to the process will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the control of BfG Party. The World DanceSport Federation shall not be liable in the event that all or any part of the service relating to BfG is discontinued, modified or changed in any way.

In the event that any Entrant does not, or is unable to, comply with and meet these terms and conditions and the BfG Information, the World DanceSport Federation shall be entitled at its sole discretion to disqualify such Entrant, without any further liability to such Entrant. In these circumstances, any prize won by the Contestant may be forfeited. All Entrants must comply with any directions given by any BfG Party including but not limited to any and all relevant laws, rules and regulations.

The invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, the remaining terms and conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

The World DanceSport Federation has no obligation of any nature to publish, promote, display or otherwise use any information provided by Entrants, including but not limited to biographical or video content.

Privacy Notice

This Privacy Notice applies to personal information collected by the World DanceSport Federation ("WDSF") in connection with the qualifying process for the Breaking Events at the Buenos Aires 2018 Youth Olympic Games. This includes information collected from Entrants online through WDSF websites, applications as well as third-party platforms and applications accessed or used through such websites or third-party platforms, and offline through WDSF, its partners, agents and assigns.

Entrants submitting their information and their legal guardians are consenting to WDSF collecting, using and disclosing personal information in accordance with this Privacy Notice.

WDSF will only collect, use or disclose such personal information where it is fair and lawful to do so. In most cases, WDSF will ask for consent explicitly but, in some cases, WDSF may infer consent from an Entrant’s actions and behaviour. WDSF may ask an Entrant to provide additional consent if needed to use his/her personal information for purposes not covered by this Privacy Notice. The Entrant is not obliged to provide such consent, but if he or she decides against it, then his or her participation in certain activities may be restricted. If an Entrant provides additional consent, the terms of that consent shall prevail in the event of any conflict with the terms of this Privacy Notice.

WDSF may process an Entrant’s personal information without consent if WDSF has a legitimate reason to do so, provided that such use will not have a prejudicial effect on the Entrant’s own rights, freedoms and interests.

Legal Agreement Under Swiss Law

This document is a binding legal Agreement and is governed by Swiss law. The parties irrevocably agree that any dispute arising from this Agreement or any actions or omissions reasonably connected with this Agreement shall be governed by the laws in Switzerland. The parties agree that any claim or cause of action under or relating to this Agreement shall be brought before the Swiss Courts and the Court of Arbitration in Sports ("CAS") at Lausanne, Switzerland.

By selecting the box on the entry form I, as parent or legal guardian, accept and agree to the foregoing terms and conditions on behalf of Entrant.
